Personal Responsibility

You are solely responsible for your interactions with other Coolintros.com Members. Coolintros.com reserves the right, but has no obligation, to monitor disputes between you and other Members. Any infraction may lead to legal remedy on behalf of Coolintros.com

You must use the Service in a manner consistent with any and all applicable laws and regulations.

Your membership in the Coolintros.com service is for your sole, personal use. You may not authorize others to use your membership, and you may not assign or otherwise transfer your account to any other person or entity.


System Security

You agree to (a) immediately notify Coolintros.com of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. Coolintros.com cannot and will not be liable for any loss or damage arising from your failure to comply with this section.

You agree not to attempt to compromise system security in any way, including without limitation, any attempt to:

• Forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Service.
• Disrupt the normal flow of dialogue, cause a screen to "scroll" faster than other users of the Service are able to type, or otherwise act in a manner that negatively affects other users' ability to engage in real time exchanges.
• Interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service.
• Upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.

Intellectual Property

You agree not to violate the intellectual property rights of others, including without limitation, any attempt to:

• Upload, post, email, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements).
• Upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party.
• Upload, post, distribute or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights.

Personal information

You agree to provide true, accurate, current and complete information about yourself as prompted by the Service's registration form.

You agree to maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or if Coolintros.com has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Coolintros.com has the right to suspend or terminate your account and refuse any and all current or future use of the Service or any portion thereof.

You agree not to include in your profile any personal contact information, including without limitation telephone numbers, street addresses, last names, URL's, or E-mail addresses.

You agree not to impersonate any person or entity, including, but not limited to, a Coolintros.com official or staff member, or falsely state or otherwise misrepresent your affiliation with any person or entity.

You are responsible for maintaining the confidentiality of your password and account, and are fully responsible for all activities that occur under your password or account.


Offensive Content

The following is a partial list of the kind of Content that is illegal or prohibited on the Website. Coolintros.com reserves the right, in its sole discretion, to investigate and take appropriate action against anyone who violates this provision, including without limitation, removing the offending communication from the Service and terminating the membership of such violators.

You agree not to upload, post, email, transmit or otherwise make available, any content that is offensive, including without limitation:

• Contains or promotes content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable.
• Contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page).
• Engages in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes.
• Harasses or advocates harassment of another person.
• Involves the transmission of "junk mail", "chain letters", or unsolicited mass mailing or "spamming".
• Contains offensive anatomical or sexual references, or offensive sexually suggestive or connotative language, or photos containing nudity or personal information. Coolintros.com reserves the right, but has no obligation, to reject any profile or photo that does not comply with these prohibitions.
• Promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files.
• Promotes information that you know is false or misleading.
• Provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses.
• Provides material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18.
• Solicits passwords or personal identifying information for commercial or unlawful purposes from other users.

Unauthorized advertising

You agree not to engage in advertising to, or solicitation of, other members to buy or sell any products or services through the Service. You agree not to transmit any chain letters or junk E-mail to other Coolintros.com Members.

Coolintros.com reserves the right to restrict the number of emails that a Member may send to other Members in any 24-hour period to a number that Coolintros.com deems appropriate in its sole discretion.


Stalking and Harassment

You agree not to "stalk" or otherwise harass any other user of this System.

You agree not to collect or store personal data about other users.


Compliance with applicable law

You will use the Coolintros.com service in a manner consistent with any and all applicable laws and regulations.

You agree not to intentionally or unintentionally violate any applicable local, state, national or international law.

General Provisions

Online Content

Opinions, advice, statements, offers, or other information or content made available through the Coolintros.com service are those of their respective authors and not of Coolintros.com, and should not necessarily be relied upon. Such authors are solely responsible for such content. Coolintros.com does not guarantee the accuracy, completeness, or usefulness of any information on the service and neither adopts nor endorses, nor is it responsible for the accuracy or reliability of any opinion, advice or statement made. Under no circumstances will Coolintros.com be responsible for any loss or damage resulting from anyone's reliance on information or other content posted on the Coolintros.com service, or transmitted to Coolintros.com members.

WARNING - PLEASE READ: It is possible that other Coolintros.com Members or users (including unauthorized users, or "hackers") may post or transmit offensive or obscene materials on the Coolintros.com service and that you may be involuntarily exposed to such offensive and obscene materials. Disputes

You are solely responsible for your interactions with other Coolintros.com Members. Coolintros.com reserves the right, but has no obligation, to monitor disputes between you and other Members.

If there is any dispute about or involving the Website and/or the Service, by using the Website, you agree that the dispute will be governed by the laws of the State of California without regard to its conflict of law provisions. You agree to personal jurisdiction by and venue in the state and federal courts of the State of California, Orange County.


Proprietary Rights

Coolintros.com respects the intellectual property of others, and we ask our users to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide Coolintros.com's Copyright Agent the following information:

1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest.
2. A description of the copyrighted work or other intellectual property that you claim has been infringed.
3. A description of where the material that you claim is infringing is located on the site.
4. Your address, telephone number, and email address.

You acknowledge and agree that the Service and any necessary software used in connection with the Service ("Software") contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that Content contained in sponsor advertisements or information presented to you through the Service or advertisers is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as expressly authorized by Coolintros.com or advertisers, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service or the Software, in whole or in part.

Coolintros.com grants you a personal, non-transferable and non-exclusive right and license to use the object code of its Software on a single computer; provided that you do not (and do not allow any third party to) copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in or otherwise transfer any right in the Software. Specialty Match Network Inc. owns and retains other proprietary rights in the Coolintros.com service. The Service contains the copyrighted material, trademarks, and other proprietary information of Specialty Match Network Inc. and its licensors. In addition, other Members may post copyrighted information, which has copyright protection whether or not it is identified as copyrighted. Except for that information which is in the public domain or for which you have been given permission, you shall not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information.

By posting information or content to any public area of Coolintros.com, you automatically grant, and you represent and warrant that you have the right to grant, to Coolintros.com and other Coolintros.com Members an irrevocable, perpetual, non-exclusive, fully-paid, worldwide license to use, copy, perform, display and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sublicenses of the foregoing.


Dealings with Advertisers

Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. You agree that Coolintros.com shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Service.

The Service may provide, or third parties may provide, links to other World Wide Web sites or resources. Because Coolintros.com has no control over such sites and resources, you acknowledge and agree that Coolintros.com is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that Coolintros.com shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.


No Resale of Service

You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Service, use of the Service, or access to the Service.


Non Commercial Use by Members

You may not engage in advertising to, or solicitation of, other Members to buy or sell any products or services through the Service. You may not transmit any chain letters or junk email to other Members. Although Coolintros.com cannot monitor the conduct of its Members off the Website, it is also a violation of these rules to use any information obtained from the Service in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any Member without their prior explicit consent. In order to protect our Members from such advertising or solicitation, Coolintros.com reserves the right to restrict the number of emails which a Member may send to other Members in any 24-hour period to a number which Coolintros.com deems appropriate in its sole discretion.


Termination

Either you or Coolintros.com may terminate your Coolintros.com membership at anytime, for any reason, effective upon sending written notice to the other party. Coolintros.com reserves the right to immediately suspend or terminate your access to the Coolintros.com service, without notice, upon any breach of this Agreement by you which is brought to Coolintros.com's attention.

You agree that Coolintros.com may, under certain circumstances and without prior notice, immediately terminate your Coolintros.com account, any associated email address, and access to the Service. Cause for such termination shall include, without limitation.

1. Breaches or violations of the Terms and Conditions or other incorporated agreements or guidelines.
2. Requests by law enforcement or other government agencies.
3. A request by you (self-initiated account deletions).
4. Discontinuance or material modification to the Service (or any part thereof).
5. Unexpected technical issues or problems, and
6. Extended periods of inactivity.

Termination of your Coolintros.com account includes

1. Removal of access to all offerings within the Service, including but not limited to Coolintros.com Mail, Chat, Greetings and Alerts.
2. Deletion of your password and all related information, files and content associated with or inside your account (or any part thereof), and
3. Barring further use of the Service.

Further, you agree that all terminations for cause shall be made in Coolintros.com's sole discretion and that Coolintros.com shall not be liable to you or any third-party for any termination of your account, any associated email address, or access to the Service.


General Practices Regarding Use and Storage

You acknowledge that Coolintros.com may establish general practices and limits concerning use of the Service, including without limitation the maximum number of days that email messages, message board postings or other uploaded Content will be retained by the Service, the maximum number of email messages that may be sent from or received by an account on the Service, the maximum size of any email message that may be sent from or received by an account on the Service, the maximum disk space that will be allotted on Coolintros.com's servers on your behalf, and the maximum number of times (and the maximum duration for which) you may access the Service in a given period of time. You agree that Coolintros.com has no responsibility or liability for the deletion or failure to store any messages and other communications or other Content maintained or transmitted by the Service. You acknowledge that Coolintros.com reserves the right to log off accounts that are inactive for an extended period of time. You further acknowledge that Coolintros.com reserves the right to change these general practices and limits at any time, in its sole discretion, with or without notice.


Modifications to Service

Coolintros.com reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that Coolintros.com shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

Disclaimers

1. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. SPECIALTY MATCH NETWORK INC. EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
2. SPECIALTY MATCH NETWORK INC. MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, AND (V) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.
3. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.
